Terms of Service

Last updated: January 2025. Please read these terms carefully before deploying services on NexterCloud.

1. Agreement to Terms

By creating an account, making a purchase, or deploying any server or service on NexterCloud ("Company", "We", "Us"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not access our services.

2. Acceptable Use Policy (AUP)

NexterCloud enforces a zero-tolerance policy against malicious or illegal activity. You agree NOT to use your services for:

  • Launching or participating in Denial of Service (DoS/DDoS) attacks, IP stressers, or botnet operations.
  • Cryptocurrency mining (PoW), Torrenting, or unauthorized network scanning.
  • Hosting, distributing, or linking to illegal content, malware, phishing sites, or stolen intellectual property.
  • Sending unsolicited bulk email (SPAM) or operating open mail relays.

3. Resource Allocation & Fair Play

All game hosting and VPS plans feature dedicated hardware allocations (RAM, NVMe storage, CPU cores). While unmetered traffic is provided for standard operations, sustained saturation of network uplinks or intentional CPU degradation designed to impact neighboring tenants will result in throttling or temporary container suspension.

4. Billing, Auto-Renewal & Payments

Services are billed on a recurring pre-paid subscription basis (Monthly, Quarterly, or Annually). Invoices are issued 7 days before due date. Failure to settle invoices within 3 days past due date will lead to automated service suspension, and termination after 7 days past due.

5. Account Responsibility & Backups

You are solely responsible for maintaining backup copies of your game saves, configurations, and database files. While NexterCloud takes automated daily infrastructure snapshots for emergency disaster recovery, we do not guarantee individual data recovery for user-deleted files.

6. Limitation of Liability

To the maximum extent permitted by law, NexterCloud shall not be held liable for indirect, incidental, or consequential damages, loss of profits, or data corruption arising out of your use of our infrastructure.
